No Slope Installed Under Pan Liner. Should They Fix It?
I am installing a completely new bathroom in my home. The shower was almost completed, and I found out my contactor did not perform a flood test. I had them perform a flood test and unfortunately a leak was found. The leak was caused by a fastener that was used to attach the pan liner to a stud and it was installed too low. This leak was fixed but during the repair, I noticed that there was no pre-slope installed under the pan liner.
I showed my contractor that the pan liner is required to be sloped per code for my city. My contractor says that they never slope the pan liner but agreed to install pre-slope to make me happy.
Unfortunately, they already installed the floor tile. I'm worried that if I have them rip it all out, I'll damage the integrity of the enclosure further.
They are going to try and peal back the liner without removing the top and outside tile on the curb. I'm not sure how they are going to tile the liner back in with the liner over the bench.
I've attached a picture of what the shower looks like now. To properly tie in the durock they are planning to remove the second row of wall tile. How should I have them fix this?

That looks like a mess. No preslope, fasteners too low, bench is pieced in, and I am almost sure the curb is not done correctly.
Give the contractor another chance by ripping everything out and redoing it correctly, to TCNA and code requirements or fire him and get your money back.
Otherwise, you will be redoing a water damaged shower in a few years.
